BFRG REWARDS – PROGRAM TERMS & CONDITIONS

Effective March 11th, 2024

PLEASE READ THE FOLLOWING TERMS & CONDITIONS (the “Program Terms”) CAREFULLY. The Big Fish Restaurant Group and its affiliates (hereinafter, “We”, “Us”, “Our”, “BFRG”) provide the BFRG Rewards Program (the “Program”). By enrolling in the Program, you agree to be bound by these and all terms of the BFRG’s Terms of Use and Privacy Policy, which are included on this site. We require that all users of the Program adhere to and comply with the following Program Terms. If you do not agree to these Terms, you are not authorized to use the Rewards Program.

ELIGIBILITY
The BFRG Rewards Program allows participating members (“Members”) to earn points & redeem offers at participating restaurant locations. Membership is free and available to any individual who: (a) is of legal age; (b) resides in a jurisdiction which legally permits participation in the rewards program; (c) provides valid and accurate personal information when enrolling in the program; and (d) has not been previously terminated from the Rewards Program.

Members are responsible for reading and understanding the Program rules, and other communications from Us about the Program to understand their rights, responsibilities, and status in the Program. Member points are personal to each Member, and they may not be sold, transferred, assigned or shared, and they may not be used by the Member for any commercial purposes. Accumulated points are promotional and have no cash value. If a Member voids a purchase or requests a refund on a eligible purchase, BFRG will deduct the points associated with that purchase from the Member’s account.

ENROLLING IN THE PROGRAM
To become a member of the Program, you must enroll through our website at https://bigfish.myguestaccount.com/guest/ or sign up via the BFRG Rewards App on your mobile device. . By enrolling in the Program, you certify that you meet the eligibility requirements and that the information you provide at the time of enrollment is accurate. There is no cost or fee to enroll in or participate in the Program.

To enroll in the Program, you will need to provide us with your name, a mobile phone number, your address, and your email address. You will also be required to select a password for use with the Program according to the password requirements shown on the Program website. In addition, you will be required to select a “favorite store.” This information is required in order for you to receive the benefits of the Program and to interact with the Program website. All information provided by Members, whether by enrolling in or by otherwise participating in the Program, is subject to the BFRG Privacy Policy.

BFRG reserves the right to limit Program participation and enrollment at any time. Limit one email address per person per membership in the Program. You are responsible for providing true and accurate information and to ensure that the information in your account profile remains updated. Program communications will be made using the information in your account profile. BFRG is not responsible for your inability to receive or redeem offers, or other Member benefits, or any other loss arising from your failure to provide and maintain accurate contact information in your Member profile.

PARTICIPATING LOCATIONS
Points can be earned and offers can be redeemed only at participating BFRG restaurants, which excludes Nick’s Fish House.

EARNING POINTS
Members will earn one (1) point for every U.S. dollar (USD$1) spent on eligible purchases at participating Big Fish Restaurant Group locations. To earn points, Member must provide the phone number associated with Member’s account profile to the bartender, server, or team member prior to payment. Eligible purchases exclude purchases made with third-party ordering services, catering orders, structured private events (i.e., wine dinners, beer dinners, rehearsal dinners, etc.) BFRG gift card purchases, service fees, comps, tips and promotions.

If Members do not provide a valid phone number prior to payment, points can be earned within 48 hours following the qualifying purchase through the BFRG Rewards App. Members must retain their original paid receipt and scan the QR code at the bottom of that receipt within the BFRG Rewards App under the “Missed Visit” tab. Codes will expire in 48 hours. A maximum of (3) three codes can be submitted per day.

OFFER LEVELS
Offers will be awarded at the 100, 200, 500 and 1,000 point levels. At 100 points, Member will receive a Thank You offer ($10 off your guest check). At 200 points, Member will receive a Complimentary Appetizer (up to $15). At 500 points, Member will receive a Free Lunch for Two (valid up to $25). And at 1,000 points, Member will receive a Dinner for Two (valid up to $50). Points are cumulative and do not expire.

BFRG reserves the right to change offers or delete offers at any time and for any reason.

OFFER REDEMPTION
To redeem an offer, Member must provide their phone number to their bartender, server or team member and ask them to redeem said offer. If more than one offer is available, the offer with the closest expiration date will be automatically applied first if Member does not select an offer to be used.

Only one (1) offer may be redeemed per guest check and no more than one (1) offer may be redeemed per guest, per visit. Only (1) one offer can be redeemed per day. Offers may not be used toward the purchase of gift cards, retail merchandise, alcohol or service fees. Offers may not be redeemed in conjunction with any other promotional offer or discount and is not valid with third-party takeout or delivery services, as well as catering and/or banquet services and fees. Rewards must be redeemed within ninety (90) days of issuance.

OFFER EXPIRATION
Offers at the 100, 200, 500 and 1,000 point levels expire within ninety (90) days of issuance.

The Birthday Reward will expire on the last day of the Member’s birthday month. If your birthday is inaccurate and needs to be updated, please contact us at [email protected].

BIRTHDAY REWARD
BFRG currently offers a “Birthday Reward” to Members during their birthday month, so long as a Member has filled this information out in their account profile. Member will receive this offer on the first day of their birthday month and the offer will expire on the last day of their birthday month. This offer is good for any dessert at any participating location, up to $12. Birthday Rewards may not be redeemed in conjunction with any other promotional offer or discount. Only one (1) offer may be redeemed per guest check and no more than one (1) offer may be redeemed per Member per visit. Only one (1) offer can be redeemed per day.

PROGRAM COMMUNICATIONS
By participating in the Program, you opt in to receive Program communications, which include, but are not limited to: marketing communication including offers and promotions as well as information regarding events and various other marketing materials via email about the Rewards Program or our restaurant locations. It is the Member’s sole responsibility to keep his or her email address updated and accurate. Members may choose at any time to opt out or change frequency of receiving transactional Program communication that contain marketing messages by unsubscribing or changing their email preference by logging into their online account and clicking ‘Communication Preferences’.

IN APP NOTIFICATIONS
If you are logged into the BFRG Rewards App and have notifications enabled for this App, you will receive notifications (1) when an offer is earned, (2) two weeks before an offer expires and (3) updates on upcoming events or promotions within the Big Fish Restaurant Group.

It is solely the guest’s responsibility to have notifications enabled on their mobile device and to read the notifications within the BFRG Rewards App. The Big Fish Restaurant Group is not liable if you do not receive a notification about an offer or an offer about to expire.

If you do not wish to receive push or pull notifications within the BFRG Rewards App, turn off notifications for the BFRG Rewards App within your device settings.

MEMBER TERMINATION
BFRG may, in its sole discretion, deactivate or permanently delete accounts at any time if such Member violate the Program Terms, engages in fraudulent activity, or otherwise abuses the Program.

BFRG employees are not allowed to participate in the Program and if an account is created for an employee, that account is liable for deletion.

UNAUTHORIZED USE
BFRG is not responsible for the use of Member’s rewards account by an unauthorized individual. In the event the Member’s rewards account is stolen or compromised, and the offers are used, Member must promptly inform BFRG, and BFRG will investigate the report and determine in its sole discretion what remedy, if any, may be available.

CHANGES TO TERMS
We reserve the right, in our sole discretion, to make changes or modifications to the Program Terms at any time and for any reason. We will alert you about any changes by updating the “last updated” date of these Program Terms and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Program Terms to stay informed of updates. You will be subject to and will be deemed to have been made aware of and to have accepted, the changes in any revised Program Terms by your continued use of the Program after the date such revised Program Terms are posted.
